Kimberly A. Spotts-Kimmel, a partner in the Business Services Group, counsels businesses that maintain an online presence in all legal aspects of internet law.  She also works with a wide range of clients, from small businesses and non-profits to large corporations, on intellectual property, advertising, and media law matters.  Kim also has unique experience in sweepstakes, contests, and promotions law.  She handles numerous matters on behalf of clients in a wide range of industries including technology, multiplatform media, publishing, and advertising.

Kim counsels clients in privacy and new media issues with respect to social networking, and e-mail and mobile marketing.

In her Internet Law practice, Kim reviews and prepares privacy policies, terms of use, and disclosures.  She counsels clients in privacy and new media issues with respect to social networking, and e-mail and mobile marketing.

Kim has significant experience in all areas of advertising, marketing, and promotions law.  She regularly reviews advertising and promotional content and advises her clients on anything that may raise legal concern.  She also reviews, prepares, and negotiates advertising and promotional contracts, from standard advertising agreements to complex agreements related to advertising campaigns, media buys and promotions, sponsorship agreements, production agreements, talent agreements, and license agreements.  Kim advises clients on federal and state regulatory matters, including those involving the Federal Trade Commission.

Kim is also well-versed in the legal implications of games of chance, sweepstakes, gaming, and complex skill contests.  She counsels clients on all aspects of these promotions including the review and drafting of sweepstakes and contest rules and prize supplier agreements as well as winner affidavits, releases, and notifications.

Kim regularly counsels clients on all aspects of intellectual property, including trademarks, copyrights, and rights of privacy and publicity.

In addition to handling complex matters related to internet, intellectual property, and advertising law, Kim offers day-to-day legal housekeeping for small businesses and large for profit and non-profit corporations alike.  She assists clients with general business formation, governance, and disputes employment issues and contract matters as well.
